Terms and conditions

These Terms govern your access to and use of Saraly, an Islamic journaling application provided by STARSHINE TECH AS. Saraly is available as both a web platform and mobile application.

1. Definitions "Account": Your registered account for accessing and using the Services. "Content": All text, images, journal entries, prompts, Islamic content, and other materials available through the Services. "Customer" or "You": The individual or legal entity using the Services. "Free Tier": The basic version of the Services available at no cost. "Islamic Content": Quranic verses, hadith, Islamic prompts, prayer times, and other religious content provided through the Services. "Personal Data": Information about an identified or identifiable individual as defined under applicable data protection laws. "Platform": The Saraly web application (https://getsaraly.com and subdomains) and iOS mobile application. "Premium Tier": The subscription-based version of the Services with enhanced features. "Services": Saraly's Islamic journaling platform, including the web platform and mobile application, and all features, functionality, and content provided therein. "Subscription": Your paid subscription to the Premium Tier Services. "Subscription Period": The period for which your Premium Tier subscription is active (monthly). "User Content": Journal entries, notes, and other content you create, upload, or submit through the Services. 2. Acceptance of Terms 2.1 Agreement to Terms By creating an Account, accessing the Platform, or using the Services in any way, you represent and warrant that: • You have read, understood, and agree to be bound by these Terms • You have the legal capacity to enter into these Terms • If you are using the Services on behalf of an organization, you have authority to bind that organization to these Terms • You are at least 13 years of age (or the minimum age required in your jurisdiction) 2.2 Changes to Terms We reserve the right to modify these Terms at any time. When we make changes: • We will update the "Last Updated" date at the top of these Terms • Significant changes will be communicated via email or through a notice on the Platform • Continued use of the Services after changes constitutes acceptance of the modified Terms • If you do not agree to modified Terms, you must stop using the Services and may cancel your Subscription 3. Account Registration and Eligibility 3.1 Account Creation To access certain features of the Services, you must create an Account by providing: • A valid email address • A secure password • Location information (for prayer times) • Islamic preferences (prayer calculation method, language preferences) 3.2 Account Security You are responsible for: • Maintaining the confidentiality of your Account credentials • All activities that occur under your Account • Notifying us immediately of any unauthorized use of your Account • Ensuring your Account information is accurate and up-to-date 3.3 Account Restrictions You may not: • Create multiple Accounts for the purpose of abuse or circumventing limitations • Share your Account credentials with others • Use another person's Account without permission • Create an Account using false or misleading information • Use the Services if you have been previously banned or suspended 4. Services and Features 4.1 Free Tier Services The Free Tier includes: • Basic journaling functionality • Limited daily Islamic prompts (rotating selection) • Prayer times for your location • Basic mood tracking • Hijri calendar display • Access to one daily Quranic verse 4.2 Premium Tier Services The Premium Tier ($5.99/month) includes all Free Tier features plus: • Unlimited journal entries with no restrictions • AI-powered personalized Islamic prompts • Advanced mood tracking and insights • Full journal history and search functionality • Export functionality (PDF, text formats) • Priority customer support • Advanced Islamic calendar features and event notifications • Multiple journal categories and organization • Offline access to your journal entries 4.3 Service Availability The Services are provided on an "as available" basis. We strive to maintain high availability but do not guarantee uninterrupted access. The Services may be temporarily unavailable due to: • Scheduled maintenance (we will provide advance notice when possible) • Technical difficulties or system failures • Circumstances beyond our control • Security-related incidents requiring immediate action 4.4 Service Modifications We reserve the right to: • Add, modify, or discontinue features of the Services • Update Islamic content and prompts • Improve AI algorithms and personalization • Change the user interface and design If we make material changes that significantly reduce the scope of the Premium Tier Services, we will provide notice and you may cancel your Subscription for a pro-rated refund. 5. Subscription and Payment 5.1 Subscription Plans Premium Tier subscriptions are available as: Monthly Subscription: $5.99 per month, billed monthly All prices are displayed in United States Dollars (USD) and exclude applicable taxes. Norwegian customers will be charged an additional 25% MVA (Value Added Tax) at checkout. Customers in other jurisdictions may be subject to local taxes or import duties. 5.2 Automatic Renewal Your Subscription will automatically renew for successive monthly periods until you cancel. You will be charged at the then-current subscription rate. 5.3 Payment Methods Payment must be made by valid credit card or other payment methods we accept. By subscribing, you: • Authorize us to charge your payment method for the Subscription fees • Agree to keep a valid payment method on file • Accept responsibility for ensuring sufficient funds or credit are available • Understand that failed payments may result in service interruption 5.4 Price Changes We reserve the right to change subscription prices. For existing subscribers: • Price changes will take effect at your next renewal date • We will provide at least 30 days' notice of price increases • You may cancel before the price change takes effect to avoid the new price • Continuing your Subscription after notice constitutes acceptance of the new price 5.5 Billing Issues If payment fails: • We will attempt to process payment multiple times • Your access to Premium features may be suspended until payment is received • You can update your payment method at any time in Account Settings • Your journal entries and data remain safe and accessible (read-only) • Once payment is successful, Premium features are immediately restored 5.6 Taxes You are responsible for all applicable taxes except those based on our net income. Norwegian customers will be charged 25% MVA (Value Added Tax) in addition to the stated subscription price. Customers in other jurisdictions are responsible for any applicable local taxes, VAT, GST, or import duties. If we are required by law to collect taxes in your jurisdiction, they will be added to your invoice and clearly displayed at checkout. 6. Cancellation and Refunds 6.1 Cancellation by You You may cancel your Subscription at any time: • Cancellation takes effect at the end of your current billing period • You will retain Premium access until the end of the paid period • No refunds will be provided for partial subscription periods • After cancellation, your Account will revert to the Free Tier 6.2 Cancellation by Us We may suspend or terminate your Account and access to the Services if: • You violate these Terms • You engage in fraudulent activity or payment disputes • You abuse the Services or harm other users • We are required to do so by law • We discontinue the Services (we will provide reasonable notice) 6.3 Refund Policy Platform-Specific Refund Policies: Web (Stripe Payments): Subscription fees are generally non-refundable except in the following cases: • 7-Day Satisfaction Guarantee: If you cancel within 7 days of your first subscription and have created fewer than 5 journal entries with Premium features, you may request a full refund. • 14-Day EU Right of Withdrawal: EU consumers who have not yet used Premium features may withdraw within 14 days for a full refund (see Section 16.3). • Technical Issues: If Premium features are unavailable for more than 48 consecutive hours due to issues within our control, you may request a pro-rated refund. • Billing Errors: If you are charged incorrectly, we will refund the erroneous amount immediately. • Exceptional Circumstances: We may grant refunds at our discretion for extraordinary situations. iOS (Apple App Store): Subscriptions purchased through the Apple App Store are subject to Apple's refund policy. We do not have access to or control over App Store refunds. To request a refund: • Visit reportaproblem.apple.com • Sign in with your Apple ID • Select "Request a refund" • Choose the Saraly subscription Apple typically grants refunds within 14 days if the service has not been extensively used. How to Request a Refund (Web only): Email contact@getsaraly.com within 30 days of the charge with: • Your account email address • Subscription date and order ID • Reason for refund request We will review and respond within 2 business days. Approved refunds are processed within 5-10 business days. Important Notes: • Refunds are processed to your original payment method • After refund, your account reverts to Free Tier • All Premium features become unavailable • Your journal entries remain accessible • You may resubscribe at any time 7. User Conduct and Prohibited Activities 7.1 Acceptable Use You agree to use the Services only for lawful purposes and in accordance with Islamic principles of respect, honesty, and dignity. 7.2 Prohibited Activities You may not engage in: Content Violations: • Post content that is offensive, hateful, discriminatory, or promotes violence • Share content that contradicts Islamic teachings or disrespects Islam • Post sexually explicit, obscene, or inappropriate material • Violate intellectual property rights of others • Share false, misleading, or defamatory information Technical Violations: • Attempt to hack, disrupt, or compromise the Services • Use automated tools (bots, scrapers) without authorization • Reverse engineer, decompile, or disassemble the Services • Introduce viruses, malware, or harmful code • Overload our systems or interfere with other users' access Commercial Violations: • Use the Services for commercial purposes without authorization • Resell, redistribute, or sublicense the Services • Create derivative works based on the Services • Use the Services to compete with us Privacy Violations: • Collect information about other users without consent • Impersonate others or misrepresent your identity • Share another user's personal information without permission 8. User Content and Intellectual Property 8.1 Your Content Rights You retain all ownership rights to your User Content (journal entries, notes, etc.). By using the Services, you grant us: • A limited, non-exclusive license to store, process, and display your User Content solely to provide the Services • The right to use anonymized, aggregated data for improving the Services • The right to access your User Content as necessary for customer support We will never: • Claim ownership of your journal entries or personal reflections • Share your private journal entries with third parties • Use your personal spiritual reflections for marketing or public purposes 8.2 Our Intellectual Property All Islamic Content, prompts, software, design, functionality, and other materials provided through the Services (excluding your User Content) are owned by us or our licensors and protected by copyright laws, trademark laws, trade secret laws, and other intellectual property laws. You receive only a limited license to use the Services as described in these Terms. You may not: • Copy, reproduce, or create derivative works from our Content • Remove or modify proprietary notices • Use our trademarks without written permission • Extract or systematically collect data from the Services 8.3 Islamic Content Sources Our Islamic Content is derived from authentic sources including: • The Holy Quran • Authentic Hadith collections • Scholarly Islamic works in the public domain • Licensed Islamic content providers • Original content created by our team and reviewed by Islamic scholars We make every effort to ensure authenticity and accuracy of Islamic Content but encourage users to verify important religious matters with qualified scholars. 8.4 Feedback and Suggestions If you provide feedback, suggestions, or ideas about the Services: • You grant us the right to use them without obligation or compensation • We may implement, modify, or disregard suggestions at our discretion • You waive any rights to claim ownership of implemented suggestions 9. Privacy and Data Protection 9.1 Privacy Policy Our collection, use, and protection of your Personal Data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at https://getsaraly.com/privacy 9.2 Data Processing We process your Personal Data as: • Data Controller: For data we collect and process for our own purposes (Account information, usage analytics, payment information) • Data Processor: For User Content you create (journal entries, personal notes, reflections) 9.3 Your Privacy Rights Depending on your location, you may have rights including: • Access to your Personal Data • Correction of inaccurate data • Deletion of your data ("right to be forgotten") • Data portability (receiving your data in a structured format) • Objection to certain processing activities • Withdrawal of consent To exercise these rights, contact us at contact@getsaraly.com 9.4 Data Security We implement appropriate technical and organizational measures to protect your data, including: • Encryption of data in transit and at rest • Regular security assessments • Access controls and authentication • Secure backup procedures However, no system is completely secure. You acknowledge that you provide data at your own risk. 9.5 Data Location and Transfers Your data may be processed in Norway, the European Union, or other countries where we or our service providers operate. We ensure appropriate safeguards are in place for international data transfers in compliance with applicable laws. 10. Islamic Content and Religious Matters 10.1 Nature of Islamic Content The Islamic Content provided through the Services is intended for personal spiritual reflection and growth, educational and informational purposes, guidance in daily Islamic practice, and inspiration and motivation. 10.2 Not Professional Religious Advice The Services do not provide formal fatwa or Islamic legal rulings, professional religious counseling, substitutes for qualified Islamic scholars, or definitive answers to complex religious questions. For significant religious matters, please consult qualified Islamic scholars or religious authorities. 10.3 Authenticity and Verification We strive to ensure all Islamic Content is authentic and properly sourced by using recognized Islamic sources (Quran, authentic Hadith), consulting with Islamic scholars, regular review and verification processes, and correcting errors when identified. However, we cannot guarantee absolute accuracy. Users should verify important religious matters independently. 10.4 Diverse Islamic Practices We recognize the diversity of Islamic practice and interpretation. Our Services aim to be respectful of different schools of thought (madhahib) while maintaining orthodox Islamic principles. 10.5 AI-Generated Islamic Content Some prompts and suggestions may be AI-generated. While we implement safeguards to ensure Islamic appropriateness: • AI content should be considered inspirational rather than authoritative • Users should apply their own Islamic knowledge and judgment • Report any content that appears un-Islamic or inappropriate • We review and improve AI systems based on feedback 11. Third-Party Services and Links 11.1 Third-Party Integrations The Services may integrate with third-party services including prayer time calculation APIs (Aladhan), Quran and Hadith databases (Quran.com, Sunnah.com), payment processors (Stripe), analytics services, and cloud storage providers. These integrations are subject to the third parties' own terms and privacy policies. 11.2 Third-Party Links The Services may contain links to third-party websites or resources. We do not endorse or control third-party content, are not responsible for their availability, accuracy, or content, do not assume liability for your use of third-party services, and recommend reviewing their terms and privacy policies. 11.3 No Warranties for Third-Party Services We provide no warranties regarding third-party services and disclaim liability for service interruptions or unavailability, inaccurate information provided by third parties, changes to third-party APIs or services, and privacy practices of third parties. 12. Service Disclaimers 12.1 Service Availability We strive to provide reliable Services, but we cannot guarantee uninterrupted access (maintenance, updates, or technical issues may occur), error-free operation (bugs may occasionally appear), compatibility with all devices or browsers, or preservation of content indefinitely without backups. Important: We recommend regularly backing up important journal entries. 12.2 Islamic Content Not Religious Authority: The Islamic content, prompts, and AI-generated suggestions are provided for personal reflection and spiritual growth. They are not formal religious rulings (fatwa), substitutes for qualified Islamic scholars, or comprehensive representations of all Islamic interpretations. Your Responsibility: For important religious questions or decisions, please consult qualified Islamic scholars or trusted religious authorities in your community. 12.3 AI Features (Premium) AI-generated content is created by artificial intelligence and may occasionally produce inaccurate or inappropriate suggestions, not fully understand complex Islamic concepts, or require your judgment and discretion. We review and improve AI outputs regularly, but you should verify important information independently. 12.4 Beta Features Features marked as "beta" or "experimental" are still being tested and improved, may change or be discontinued based on user feedback, and may contain more bugs than stable features. We appreciate your patience and feedback during beta testing. 13. Limitation of Liability 13.1 Our Commitment We take our responsibility seriously and will make reasonable efforts to provide reliable Services. However, we must limit our legal liability to operate sustainably as a small business. 13.2 Liability Cap If we fail to meet our obligations under these Terms, our total liability to you is limited to the fees you paid in the previous 3 months, or 100 USD (whichever is greater). Example: If you paid $5.99/month for 2 months, the maximum we would owe is $100 USD. 13.3 Important Exceptions These limitations do not affect your data protection rights under GDPR, our liability for fraud or intentional misconduct, or any consumer rights that Norwegian or EU law prohibits us from limiting. 13.4 Types of Damages Not Covered We are not responsible for indirect consequences such as lost business opportunities or profits, emotional distress (beyond what consumer law requires), consequences of relying on AI-generated suggestions without independent verification, issues caused by third-party services (payment processors, API providers), or events beyond our control (natural disasters, internet outages, cyber attacks). 13.5 Fair Allocation This limitation allows us to offer affordable pricing ($5.99/month) while protecting the business. Without these limits, we would need to charge significantly more or purchase expensive insurance. 14. Dispute Resolution 14.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. 14.2 Amicable Resolution Before initiating formal legal proceedings, we encourage you to contact us at contact@getsaraly.com to attempt to resolve disputes amicably. We commit to working in good faith to resolve concerns. 14.3 Informal Negotiation Period Both parties agree to attempt informal resolution for at least 60 calendar days, engage in good faith negotiations, provide clear description of the dispute and desired resolution, and exchange relevant information necessary for resolution. 14.4 Jurisdiction and Venue If informal resolution fails, you agree that any legal action or proceeding shall be brought exclusively in the courts of Norway, the venue shall be Oslo tingrett (Oslo District Court), you consent to the personal jurisdiction of Norwegian courts, and you waive any objection to venue or jurisdiction. 14.5 Exception for Small Claims Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies. 14.6 No Class Actions You agree that any dispute resolution proceedings will be conducted on an individual basis, you waive the right to participate in class actions or class arbitrations, and claims may not be brought as a representative or in a representative capacity. 15. General Provisions 15.1 Entire Agreement These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and STARSHINE TECH AS regarding the Services and supersede all prior agreements and understandings. 15.2 Severability If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed. The remaining provisions shall remain in full force and effect. 15.3 Waiver Our failure to enforce any right or provision in these Terms shall not constitute a waiver of that right or provision, any other rights or provisions, or our right to enforce such provisions in the future. Any waiver must be in writing and signed by an authorized representative. 15.4 Assignment You may not assign, transfer, or delegate these Terms or your rights and obligations without our prior written consent. We may assign these Terms to an affiliate or subsidiary, in connection with a merger, acquisition, or sale of assets, or to any successor or assign. 15.5 Force Majeure We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God (earthquakes, floods, fires), war, terrorism, or civil unrest, government actions or regulations, pandemic or epidemic, internet or telecommunications failures, or power outages or equipment failures. 15.6 Survival The following provisions shall survive termination of these Terms: sections regarding Intellectual Property, disclaimers and limitations of liability, dispute resolution, and any provisions that by their nature should survive. 15.7 Headings Section headings are for convenience only and shall not affect the interpretation of these Terms. 15.8 Language These Terms are provided in English. In case of any inconsistency between translations, the English version shall prevail. 15.9 Electronic Communications You consent to receive communications from us electronically, including email notifications, messages through the Platform, updates to these Terms, and service announcements. You agree that electronic communications satisfy any legal requirement for written communications. 15.10 Relationship of Parties Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and STARSHINE TECH AS. You have no authority to bind us or make commitments on our behalf. 16. Special Provisions for European Users 16.1 GDPR Compliance For users in the European Economic Area (EEA), United Kingdom, or Switzerland: we process Personal Data in accordance with GDPR, you have enhanced rights regarding your Personal Data, we maintain appropriate data processing agreements with processors, and data transfers outside the EEA are protected by appropriate safeguards. 16.2 Consumer Rights EU consumer protection laws may provide you with additional rights that cannot be waived by these Terms, including right to withdraw from distance contracts within 14 days, enhanced warranty and guarantee rights, protection against unfair contract terms, and right to have defective digital content repaired or replaced. 16.3 EU Right of Withdrawal 14-Day Cooling-Off Period: EU consumers have the right to withdraw from this contract within 14 days without giving any reason, in accordance with EU Directive 2011/83/EU. Waiver by Use: By checking the box at checkout and beginning to use Premium features before the 14-day period expires, you expressly request immediate performance of the contract and acknowledge that you will lose your right of withdrawal once you start using the Premium features. How to Exercise Withdrawal: To exercise your right of withdrawal within 14 days of purchase (if you have not yet used Premium features), contact us at contact@getsaraly.com with your name and email address, order/subscription ID, and statement that you wish to withdraw from the contract. We will process your full refund within 14 days of receiving your withdrawal notice. 17. If unresolved, EU consumers may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Norwegian users may contact the Norwegian Consumer Authority. Data protection complaints may be filed with the Norwegian Data Protection Authority (Datatilsynet). 18. Acknowledgment By using Saraly, you acknowledge that you have read and understood these Terms in their entirety, you agree to be bound by these Terms, you understand that we may update these Terms from time to time, you will review these Terms periodically for changes, and continued use after changes constitutes acceptance of modified Terms.
